Refund requests and distance selling act.
Hello. I’m just reviewing the T&C’s for my web site. I intend to sell off the shelf and/or semi-bespoke web-sites via my web site which I think would come under the distance selling act. As I understand it (correct me if I’m wrong) under the distance selling act I must allow a customer 7 days to return the product for a refund without any given reason on the customer’s part. As it is software that I sell this would mean that the customer could make a purchase, copy the software and then request a refund. Is this true? Thanks in advance John
Is there really nobody out there who knows about this?
Have a look at page 2 & page 9 of this http://www.oft.gov.uk/shared_oft/business_leaflets/general/oft913.pdf
Business to Business sales (which I guess some of yours will be) are exempt from Distance Selling Regulations.
If products you are selling are totally bespoke then you can stop people from cancelling their order. If they are off the shelf you probably cannot.
